This Acceptable Use Policy (“Policy”) establishes the rules, responsibilities, and prohibited conduct related to your use of the GemX application (“GemX”, “the Service”, “we”, “us”, or “our”), a proprietary product developed and operated by GemCommerce Company Limited (the “Company”). This Policy is designed to uphold the integrity, security, and lawful operation of the Service and mitigate legal, regulatory, reputational, and operational risks for both the Company and its Users.

By accessing, installing, or using GemX in any manner, you acknowledge and agree to be bound by the terms of this Policy. Any violation of this Policy may result in the suspension or termination of your account and other appropriate legal action.

1. Prohibited Activities

The following activities are strictly prohibited when using GemX. The examples provided are not exhaustive.

1.1. Security and System Integrity Violations

  • Attempting to gain unauthorized access to GemX systems, data, or accounts.
  • Circumventing, bypassing, disabling, or interfering with any authentication, authorization, or security measures.
  • Reverse engineering, decompiling, probing, or testing the vulnerability of any part of GemX.
  • Using bots, scripts, or automated tools to access or interact with the Service.
  • Launching or attempting to launch denial-of-service (DoS), distributed DoS, or similar attacks.
  • Monitoring or crawling GemX infrastructure in a manner that disrupts or impairs system performance.
  • Altering third-party websites or services to falsely imply an association with GemX.

1.2. Improper Use of the Application

  • Using GemX in violation of any applicable law, regulation, legal obligation or Shopify’s Polices.
  • Accessing, storing, or using Shopify merchant or customer data in violation of Shopify’s API and Partner Terms, or without proper authorization or transparency to the merchant.
  • Submitting fraudulent, misleading, or intentionally manipulated A/B test data that may misrepresent outcomes or affect billing, optimization decisions, or Shopify merchant operations.
  • Attempting to avoid incurring fees or Shopify’s or GemX’s billing systems, including manipulation of test limits, user tiers, billing cycles, or API calls.
  • Using the application for benchmarking or reverse-engineering in competition with GemX.
  • Sharing, sublicensing, reselling, or otherwise redistributing GemX without written authorization.
  • Misrepresenting your identity or affiliations.

1.3. Misuse of Communication Channels

  • Engaging in harassment, abusive behavior, or threats toward GemX representatives through any communication channel.
  • Sending unsolicited messages, spam, promotional content, or phishing attempts.
  • Making knowingly false or defamatory public statements, or submitting reviews intended to coerce, manipulate, or gain undue advantages from GemX.
  • Impersonating a GemX employee, representative, or affiliate in any form.

1.4. Uploading or Distributing Inappropriate Content

  • Uploading, sharing, or storing content that infringes on third-party intellectual property rights.
  • Submitting content that is fraudulent, obscene, pornographic, defamatory, hateful, or otherwise unlawful.
  • Posting content that discriminates or promotes violence or hate based on race, ethnicity, religion, gender, sexual orientation, disability, or medical condition.
  • Introducing viruses, malware, spyware, or malicious code to the GemX platform.

2. Reporting and Enforcement

GemX reserves the right to investigate suspected violations of this Policy. We may report any illegal activities to appropriate authorities and cooperate with law enforcement as required.

GemX may suspend, restrict, or permanently terminate your access to the Service, without prior notice or liability, if we determine, at our sole discretion, that your use violates this Policy, poses a security risk, or is otherwise harmful to the integrity of the platform or other users.

3. Policy Modifications

We may revise and update this Policy at any time without prior notice. Revised versions will be made available on the official GemX website and will become effective as of the date of publication. Your continued use of the Service following any changes constitutes your acceptance of the updated Policy.
